PEABODY — The Newburyport man who crashed into a Massachusetts State Police cruiser early Sunday morning on Route 1 has been taken into Immigration and Customs Enforcement (ICE) custody.
Lucas Gustavo Brajak DeAlmeida DiBenedetto, 41, was charged with operating under the influence of liquor and negligent operation of a motor vehicle; he was also issued a citation for driving the wrong way on a state highway.
A bail magistrate imposed a $500 cash bail, and DiBenedetto was released upon posting bail. He was scheduled to appear for arraignment on Tuesday at 8:30 a.m.
Upon arriving at Peabody District Court, and prior to his scheduled arraignment, DiBenedetto was taken into ICE custody. It has been previously reported that the ICE officers admitted to waiting for DiBenedetto to arrive for his arraignment to detain him.
The Essex District Attorney’s office stated that, at the request of the Commonwealth, DiBenedetto’s case has defaulted.
